Person-Centered Dog Training Program Terms & Conditions and Code of Conduct 

TERMS OF USE: Person-Centered Dog Training

By checking the box agreeing to Terms of Use at checkout, typing full name at check out, and clicking the “Purchase” button, you, the purchaser of the Person-Centered Dog Training Program outlined below (hereinafter “Client”) agree and willingly purchase entry into this group coaching and informational program, to be provided with services rendered by Jessica Adam, acting as part of Handlers & Humans, LLC, a Pennsylvania LLC, (hereinafter “Coach”), and you agree you are voluntarily entering into a legally binding Agreement with Coach, inclusive of the following terms and conditions mutually agreed upon: 

For listed or agreed upon purchase price, Client has agreed to purchase the Person-Centered Dog Training Program (hereinafter “Program”). In exchange, Coach agrees to provide the services outlined in the Program Details below.

PROGRAM DETAILS

For the cost of eight hundred seventy six dollars ($876.00 USD) Client agrees and understands that he/she is purchasing Person-Centered Dog Training Program, an informational online course and group coaching program for canine professionals. The program includes lifetime access to recorded course content and materials (video lectures, worksheets), 16 scheduled live group coaching sessions over 8 weeks, and 8 weeks access to private discussion community.

Once Client has joined and start date begins, the Program will run for a period of 8 weeks. During this time, Coach will provide the following products and/or services to all members:

  • Online course comprised of video lessons, worksheets, and other materials (lifetime access)
  • 16 case consultation live group coaching sessions (not recorded, no lifetime access)
  • PDF downloads of any materials, workbooks, and journals as applicable to program
  • Access to private community group for 8 week period

Note: Some professional dog training organizations may allow Person-Centered Dog Training Program to be eligible for Continuing Education credits. Handlers & Humans, LLC can NOT guarantee Continuing Education approval for Person-Centered Dog Training Program. Continuing education is NOT a guaranteed element or offering of Program but MAY BE an additional offering if Clients’ professional organizations approve. If Client has utilized a payment plan to purchase the Program, Continuing Education credits will not be granted if payments fail to be made. Client may only submit for continuing education credits at the completion and fulfillment of their payment plan. CLIENT UNDERSTANDS AND AGREES THAT it is the sole responsibility of clients/participants to inquire about eligibility of Program for continuing education through their particular professional organization and that Handlers & Humans, LLC cannot and does not guarantee Continuing Education eligibility. 

Client has carefully read this Program Outline and acknowledges that he/she is aware of what is, and what is not included within this Program. Client is aware that this Program Detail section includes EVERYTHING included within the Program. If Client expected additional information, products, services, or other information to be provided in this Program but does not see it here, Client understands it may not be included. Coach is under no obligation to provide anything other than what is listed above, with the exception of updated or ever-changing Bonuses offered for limited periods of time. No edits or amendments may be made to this Program Outline.

By completing the online purchase and being charged the amount listed above, Client confirms he or she has reviewed this Program Outline, completed any and all appropriate additional research, and asked any and all necessary questions of Coach and his/her team in order to feel appropriately educated of the Program and product/service being offered. Client understands he or she will not be entitled to a refund once completing this purchase.

Medical Disclaimer – Not Medical or Professional Advice 

 The purpose and goal of Program is to provide group coaching services and informational materials. Program and content contained within the Program is not to be considered medical advice, and nothing within the Program is intended to provide or act as a substitute for mental health treatment. 

Client understands and agrees that while Coach is a licensed professional counselor and has been trained and educated to provide counseling services in the Commonwealth of Pennsylvania, Program offers coaching services only, separate and apart from Coach’s professional practice or licensure. 

There are no counseling or therapy-based elements to Program, and Program is not meant for those who are in need of (or think they may be in need of) counseling or therapy services. 

Client’s enrollment into Program does not make him/her Coach’s patient, and no therapist-patient relationship is being formed. Coach is not attempting nor suggesting Client enroll in Program in place of a personalized consultation with a licensed professional counselor in your geographical area. Program is not intended to be a substitute for medical treatment or therapy/counseling, nor is Program designed to provide Client with a medical diagnosis, treatment, or other medical services. 

By checking the box next to this Terms of Use, typing full name, and clicking the “Purchase” button, you, the purchaser of the Person-Centered Dog Training Program (Client) understands and agrees Program is not providing any medical advice, is not providing any counseling or therapy services, is not a substitute to Client seeking personalized therapy for his/herself, nor is it attempting to diagnose or treat any mental or physical medical conditions. 

 Coach encourages Client to consult a physician and/or a licensed therapist if he/she suspects he/she may benefit from such services. We will assume that all individuals choosing to purchase Program will have previously obtained clearance and permission from their applicable personal medical physician or therapist and has concluded that the coaching Program offered is right for them. Nothing contained within Program is intended to diagnose, cure, treat, or prevent any medical condition or disease, nor is it to be considered medical advice in any capacity.

 

CONFIDENTIALITY

Coach respects each client’s privacy, and will not reveal anything said by Client in coaching sessions or in online group without prior written consent from Client, other than in the following scenarios: 

Suspected abuse to another individual or self, with your written permission, fee or contractual dispute, unintentional breach due to electronic or online communication (including but not limited to e-mail, Facebook messenger, Instagram direct messaging, WhatsApp, etc.,), and phone and video recorded sessions.

This Agreement is considered a mutual non-disclosure agreement, meaning both Client and Coach agree not to disclose, reveal, or make use of any confidential information they may learn about either party during discussions, coaching sessions, calls, emails, or otherwise. Such “Confidential Information” includes, but is not limited to, financial information, coaching strategies, exercises, or other methodologies Client learns as a result of working with Coach, plans or outlines for future programs or packages, information contained in documents or any other original work created by Coach, and any and all other intellectual property (discussed below.) Client understands and acknowledges that this information is not to be openly shared with others who have not participated in Coach’s program, and agrees not to share, copy, or distribute any documents or other proprietary information obtained through Program. Client agrees that he or she will be in violation of these Terms of Use if he or she uses any of the Content outlined as his/her own material, or repurposes and uses the Content in his/her own coaching business without express written permission of Coach. Client also understands and agrees he/she will not disclose or use any information provided to Client during coaching sessions, discussions, or otherwise. 

Client and Coach agree that the responsibility to refrain from disclosing or sharing any and all Confidential Information learned as a result of Client working with Coach shall survive the expiration of this Agreement and Coach’s services. This means Client and Coach both agree to continue to keep Confidential Information private, even after the completion of working with Coach. 

Should Client breach this provision and disclose confidential or proprietary information belonging to Coach or another participating in the Program, Client understands additional action may be taken by Coach up to and including legal action.

If any services within Program include sessions via phone, Zoom, Skype, or any other form of online video or audio session, Client understands the risks and potential consequences of such sessions, including but not limited to the possibility that the transmission of information could be distorted, interrupted, or accessed by unauthorized persons. Client gives his/her informed consent to engage in phone or online video sessions as part of his/her coaching package.  

Client also understands that due to the “group” nature of the Program, he/she may also obtain access to or otherwise become exposed to confidential or proprietary information belonging to other clients within the same group program via the community chat board available to all members within the membership portal. Client understands and agrees he/she will not disclose, steal, use, distribute, copy, or otherwise share or use any proprietary or confidential information belonging to another client in the group program. Client understands if he/she violates this provision, he or she may be liable to the third-party group member for infringement. Client will hold Coach harmless from any such third-party action taken against Client for such infringement or disclosure.

 TESTIMONIALS 

Coach may request Client provide a testimonial to be published on Coach’s website, or on various sales materials for this or another Program created by Coach. Client understands that he or she is not required to give any testimony, and understands that the choice to do so is freely up to Client. There will be no ramifications or change in relationship between Coach and Client if Client refuses testimonial. 

If Client accepts and provides Coach with a testimonial, Client understands the material, along with a photo of Client, will likely be published on Coach’s website, social media, or otherwise. Should Client agree to provide a testimonial, Client confirms Coach’s rights to use Client’s testimonial. No payment or additional services will be provided in return for Testimonial, and Client understands he or she is granting Coach an unlimited, irrevocable license in perpetuity to use, publish, distribute, or repurpose any information provided to Coach as part of a Testimonial. 

PAYMENT AND PAYMENT PLANS

Client understands the cost of the program is eight hundred seventy six dollars ($876.00 USD), which is payable up front, in full, unless a payment plan has been offered by Coach, or otherwise arranged between Coach and Client. Client agrees to render payment via PayPal or credit card via Stripe. Client understands he/she is responsible for the full payment and agrees to pay the sum requested electronically, via Coach’s website or a designated third party payment processor of Coach’s choosing, in full. Absent an agreement regarding a payment plan with Coach, Client must complete payment in full before becoming entitled to any products or services included within Program. 

If a payment plan is arranged with Coach, should Client fail to make timely payments, or if additional payments are not able to be processed, Client understands that access to program content, coaching calls, and support community may be forfeited if payment is not made within three days of the date it is due.

Coach reserves the right to cancel or cease working with Client should he/she fail to make additional payments in accordance with the payment plan as agreed upon at the beginning of the Program. Should this occur, Client understands she is not entitled to a refund of funds already issued to Coach in exchange for work completed thus far, and it is up to the sole discretion of Coach whether Client is to have continued access to any materials made available to Client during the Program up until payments were missed.

If Client is seeking Continuing Education for completing the course, but fails to honor and complete payment plan, Continuing Education credits will not be granted. Client may only submit for continuing education credits at the conclusion and fulfillment of the payment plan.

If Client and Coach have not agreed upon any other payment plan, Client understands one is not available, and agrees to provide payment in full, upfront, in the manner(s) designated on Coach’s sales page. 

REFUND POLICY

Due to the subjective nature of the Program provided by Coach, immediate access to electronic materials upon payment, and Coach’s inability to control Client’s availability, motivation, external forces, financial situation, or level of engagement in Program, Coach is not able to offer refunds once Client has purchased the program. 

If Coach is somehow unable to provide services as outlined on sales page, regardless of Client results, Coach or his/her team will be in touch regarding rescheduling, refunds, and/or discussing an alternative form of services, in order to fulfill obligations. 

If Coach is not able to reschedule, and no suitable alternative form of service is available, Client may be entitled to a partial refund, depending on the amount of work Coach and Client were able to complete. If partial services were performed, Coach and Client may come to an agreement whereby a partial refund is issued, at Coach’s discretion. 

  Discontinuation of Program

 Program does not provide any medical advice, treatment, or counseling/therapy services to Client. If at any point during Program, Coach believes Client to be in need of therapy treatment or other counseling services, Coach will advise Client of this, and offer to provide a referral to a licensed professional, if Coach knows of one in Client’s geographical area. Client has the right to refuse this referral and ignore the recommendation; however, Client may be asked to discontinue use of Program for his/own well-being, until such treatment can be provided. 

 If Client has not completed Program at the time of discontinuation, any decisions regarding partial refunds are the sole decision of Coach, and may or may not be offered. 

Voluntary Participation

 Client understands and agrees that he/she is voluntarily choosing to enroll in Program and is solely responsible for any outcomes or results. While Coach believes in her services and that Program is able to help many people, You acknowledge and agree that Handlers & Humans, LLC is not responsible nor liable to Client should Client sustain any injuries, incur harm, or encounter any negative ramifications. Client agrees that he/she is fully responsible for his/her health and well-being, including participation in Program and any results therein. 

Disclaimer / No Guarantees

Client understands that he or she must actively participate in the full Program in order to see results; however, results are not guaranteed. While many of Coach’s past and current clients have experienced wonderful benefits from the Program, and Coach and his/her team will act in their full capacity to ensure your success and happiness in the Program, Coach cannot guarantee results of the Program, and cannot make any representations or guarantees regarding individual results. Client will hold Coach and Program harmless if he or she does not experience the desired results. 

 Earnings Disclaimer: Coach also does not make any guarantees or assurances regarding a particular financial outcome based on use of Program, nor is Coach responsible for Client earnings, or any increase or decrease in finances based upon information within Program. Any information or testimonials regarding past or current clients’ participation in programs, or working with Coach contained on Website or in sales material that contain financial information are individual, and results may vary. 

Client understands that all services provided by Coach in connection with the Program being purchased are provided on an “as is” basis, meaning it is without any guarantees, representations, or warranties, including but not limited to warranties relating to quality, non-infringement, fitness for a particular purpose, merchantability, or expectation or course of performance. Client is choosing to purchase this Program and work with Coach on a purely voluntary basis and does not hold Coach or Program responsible should Client become dissatisfied with any portion of the Program. 

Client agrees that he/she does not have a cause of action, legal remedy, and is not entitled to a refund should he/she not achieve the results desired following completion of the program, as long as Coach delivers the Program as described in Paragraph 1 above, or similar substitutes, upon additional agreement by Coach and Client.

Client agrees to hold Coach harmless should any physical, emotional, or financial injury occur as a direct or indirect result of the Program. The content provided by Coach on his/her website and within the Program is comprised of information that has worked for Coach and other clients, and may or may not be useful to Client in his/her personal business or life. Client understands Coach cannot guarantee results from this Program, and has no expectation of a specific result that he or she holds Coach responsible for. 

Waiver/Assumption of the Risk

Client understands he/she is entering into a Program for the purpose of achieving a desired professional, or personal goal through Coach’s Program. Client confirms he/she is entering into this Program voluntarily and of his/her own free will. 

Client certifies he/she has or will be evaluated by his/her personal physician and obtain medical clearance prior to beginning any fitness, exercise, diet, health or wellness-related program with Coach. If Client elects not to obtain this medical clearance prior to beginning Program, he/she understands the potential ramifications of such actions and agrees not to hold Coach responsible for any such injuries or negative consequences. 

Client understands Program may include elements of diet and exercise, which bring inherent risks of illness, injury, or other similar unanticipated consequences. Client agrees he/she is aware of and assuming these risks in order to voluntarily proceed with Coach’s Program. Should any such incidents occur, Client understands it is of no fault or responsibility of Coach, and agrees Coach is not liable. 

Intellectual Property 

Licensee Rights: Coach’s Limited License to Client: Client understands that in purchasing the Program, she/he is gaining access to view all content and information available as part of the Program for the above listed duration of the program, as well as any additional information or content shared with him/her by Coach as she sees fit. Client understands this means he/she will have been granted a limited, revocable, non-transferrable license to read and use the information provided for use in his/her business and life, as instructed or allowed by Coach. As a “Licensee,” Client understands and agrees that Client will not: 

Copy, edit, distribute, duplicate or steal any information or any Content obtained through Program without written permission by Coach; post, distribute, copy, steal or otherwise use any portion of the Program or its content, or information obtained via other members in the group Program without written permission by Coach, and understand that any such use may constitute infringement, which may give rise to a cause of action against Client.

Claim any content created by Coach as part of the Program or otherwise given to Client is his/her own, meaning he/she cannot claim any content created by Coach was Client’s work, and use in his/her business as his/her own; share purchased materials, information, content with others who have not purchased them.

Client further acknowledges and understands that any such actions including but not limited to those outlined above will likely constitute infringement and/or theft of Coach’s work, and a violation of this Agreement and United States Federal laws.

Client agrees and understands that Coach has created numerous original, creative works in connection with the Program, and agrees that Coach maintains all copyrights and other intellectual property rights in all original or derivative content associated with or included in the Program, whether created prior to working with Client or specifically for Client, including but not limited to: documents, charts, emails, graphs, products, systems, processes, handouts, worksheets, copy for website or sales pages, and any other original work created by Coach. Client agrees she may be granted a limited right to use selected materials in the course of his or her own business, but understands that the original proprietary rights remain with Coach. Nothing in this Agreement shall constitute a transfer of ownership of any Intellectual Property from Coach to Client, nor grant any license to use the information, other than that which is expressly provided throughout the course of the Program. 

Client agrees and understands he/she is not to copy, repost, alter, publish, sell, assist others in selling, manipulate, distribute, or in any way exploit any of the content or intellectual property provided by Coach or obtained through working with Coach, without Coach’s express written consent. If such behavior is discovered or suspected, Coach reserves the right to immediately end Client’s participation in the Program without refund, as well as access to any program or materials Client may have purchased, without refund, and reserve the right to prosecute any actionable infringement or misuse to the full extent of the law.  

 Indemnification 

Client agrees at all times to defend, fully indemnify and hold Coach and any affiliates, agents, team members or other party associated with Coach harmless from any causes of action, injury, illness, misunderstanding, damages, losses, costs, expenses incurred as a result of Client’s use of Program, as well as any third-party claims of any kind (including attorney’s fees) arising from his/her actions as a direct or indirect result of Client’s participation in Program. Should Coach be required to defend herself in any action directly or indirectly involving Client, or an action where we decide Client’s participation or assistance would benefit Coach’s defense, Client agrees to participate and provide any evidence, documents, testimony, or other information deemed useful by Coach, free of charge. 

 Dispute Resolution 

Should a dispute arise between Coach and Client, the parties agree to attempt to resolve by good-faith negotiations and discussions. (Client agrees that failure to see results is not a basis for a “dispute” and agrees he or she does not hold Coach responsible for any specific results, or those results which have been achieved by other clients of Coach.) 

If unable to reach a resolution informally, Client and Coach agree that all disputes will be submitted for Arbitration by the American Arbitration Association, to be completed in Fleetwood, Pennsylvania, USA within a reasonable amount of time. Client and Coach agree to participate in the arbitration process in good faith and in a manner that will effectively and efficiently resolve the dispute at hand, including the exchange of any materials, documents, or information. The decision made by the arbitrator is to be final and binding on both parties, and is not to be appealed or otherwise set aside. It is to be enforceable in any court of proper jurisdiction as a judgement of law or decree. 

 Applicable Law

 This Agreement shall be governed by and under control of the laws of Pennsylvania regardless of conflict of law principles, and regardless of location of Client. Client understands this and agrees that the laws of Pennsylvania are to be applicable here. 

 Amendments

 This agreement is not to be altered, amended, changed, extended, or considered waived without execution of an additional addendum signed by both Client and Coach, or a party authorized to sign on behalf of either party.

PERSON-CENTERED DOG TRAINING CODE OF CONDUCT

Code of Conduct

Person-Centered Dog Training group and the Person-Centered Canine Professional community is dedicated to providing a place for canine professionals of all kinds to connect, learn from, and support one another. This will be a supportive and harassment-free experience for everyone. 

  • In this community, we believe that all canine professionals deserve to BE supported IN support of their clients.
  • We will not tolerate harassment of group members in any form. 
  • Courteous and inclusive DISCUSSION of training styles/methods is permitted ONLY IF training feedback is expressly requested, but DEBATE is not permitted. 
  • This is not a place to debate or belittle the merit of trainers, training methods, tools, etc. as this program and community are focused on providing support and education surrounding the human emotional health element of the dog training process ONLY. 

Any breech of the Code of Conduct will be taken seriously and may lead to removal from the Program or Community without refund.

Applicability and Scope

This code of conduct applies to all of this community's spaces, including public channels, private channels, threads, direct messages, voice rooms, comment sections, and live events, both online and off. Anyone who violates this code of conduct may be expelled from these spaces at the discretion of Coach.

Toward a Welcoming and Safe Environment

We hope to create an environment in which diverse individuals can collaborate and interact in a positive and affirming way. Examples of behavior that contributes to creating this sort of environment include:

  • Using welcoming and inclusive language
  • Being respectful of differing views, training styles, & experiences
  • Gracefully accepting constructive criticism
  • Showing empathy towards other community members
  • Only offering feedback on that which is expressly requested by individuals

Anti-Harassment Statement

This community will not tolerate harassment of any kind. Examples of harassment include:

  • Offensive comments related to gender, gender identity and expression, sexual orientation, disability, mental illness, neuro(a)typicality, physical appearance, pregnancy status, veteran status, political affiliation, marital status, body size, age, race, national origin, ethnic origin, nationality, immigration status, language, religion or lack thereof, or other identity marker. This includes anti-Indigenous/Nativeness and anti-Blackness, as well as negative comments on training style preferences.
  • Unwelcome comments regarding a person's lifestyle choices and practices, including those related to food, health, parenting, relationships, drugs, and employment.
  • Deliberate misgendering, using inappropriate pronouns, or use of "dead" or rejected names.
  • Gratuitous or off-topic sexual images or behavior in spaces where they're not appropriate.
  • Physical contact and simulated physical contact (eg, textual descriptions like "hug" or "backrub") without consent or after a request to stop.
  • Threats of violence.
  • Incitement of violence towards any individual or group, including encouraging a person to commit suicide or to engage in self-harm.
  • Deliberate intimidation.
  • Stalking or following - online or in the physical world.
  • Harassing photography or recording, including logging online activity for harassment purposes.
  • Sustained disruption of discussion.
  • Unwelcome sexual attention.
  • Patterns of inappropriate social contact, such as requesting/assuming inappropriate levels of intimacy with others.
  • Continued one-on-one communication after requests to cease.
  • Deliberate "outing" of any aspect of a person's identity without their consent except as necessary to protect vulnerable people from intentional abuse.
  • Publication of non-harassing private communication.

No screenshots or sharing of information from within the Person-Centered Dog Training spaces shall be shared to outside sources for any reason. Sharing of this information will result in an immediate removal from the program and community.

If you have questions or concerns about these issues please feel free to message Coach or ask for an opportunity to explore the issue with Coach.

Reporting

If you are being harassed by a member of our community, notice that someone else is being harassed, or have any other concerns, please contact the administrators via [email protected]. 

Coach will respond to any complaint as promptly as possible. If you do not get a timely response then please put your personal safety and well-being first, and consider logging out until you receive an email response.

This code of conduct applies to our community's spaces, but if you are being harassed by a member of our community outside our spaces, we still want to know about it. We will take all good-faith reports of harassment by our member seriously. This includes harassment outside the space and harassment that took place at any point in time. Coach reserves the right to exclude people from the group and community based on their past behavior, including behavior outside of our spaces and behavior towards people who are not in this community.

Coach reserves the right to reject any report believed to have been made in bad faith. Reports intended to silence legitimate criticism may be deleted without response.

Enforcement Process

Every code of conduct violation report will be treated with seriousness and care. If a member's immediate safety and security is threatened, Coach may take any action that they deem appropriate, up to and including banning the offender from the group or community. In less urgent situations, Coach will discuss the offense with a support team and mutually arrive at a suitable response, which will be shared with the offender privately. Whatever the resolution that they decide upon, the decision of the admins involved in a violation case will be considered final.

We will respect confidentiality requests for the purpose of protecting victims of abuse. At our discretion, we may publicly name a person about whom we've received harassment complaints, or privately warn third parties about them, if we believe that doing so will increase the safety of our members or the general public. We will not name harassment victims without their affirmative consent.

Consequences

Participants/subscribers asked to stop any behavior which violates our hold harmless or code of conduct are expected to comply immediately. If a participant continues to engage in these, or other violative behaviors, Coach may take any action they deem appropriate, up to and including expulsion from the community and identification of the participant as a harasser to other members. At the discretion of the admins, or by request, one or more of the parties involved may request to discuss the violation and how to avoid similar situations in the future.

 

By subscribing to Person-Centered Canine Professionals and all of its online, in-person, and live spaces, the subscriber/owner(s) agrees to/that:

  • Save and hold harmless Handlers & Humans LLC, and all of their affiliates from any and all claims for damages, whatsoever including but not limited to personal injury, loss of property, economic losses, or injury or illness to any canines.
  • not replicate, duplicate or share or any and all information, personal details, images or videos contained within Handlers & Humans spaces, without prior written consent.
  • not share any passwords, logins, or confidential information with others.
  • Any and all businesses, products, advice and information is provided as an educational tool, and Handlers & Humans, LLC is neither promoting or attesting to the knowledge or abilities of these businesses.
