Terms of Use: Emotional First Aid Kit for Dog Lovers

Please read these Terms of Use in full before enrolling in or using the Coping With Canines Emotional First Aid Kit (the "Program"). The Program and its content are owned by Jessica Adam and Handlers & Humans LLC (the "Coach").

"Client," "you," or "your" means the person enrolling in and using the Program. "Use" or "participation" means reading, watching, downloading, implementing, or otherwise engaging with the Program. By enrolling in and using the Program, you voluntarily agree to these Terms of Use.

1. IMPORTANT NOTICE: THIS IS NOT THERAPY

The Program is not a substitute for therapy, counseling services, or any medical or mental health treatment. While Coach is a licensed professional counselor in the Commonwealth of Pennsylvania, the Program does not include therapy or counseling services and is not designed to diagnose or treat any mental, emotional, or medical condition. Enrolling in the Program does not make you a patient of Coach, and no therapist-patient relationship is formed.

The Program also does not include dog training advice. Coach is not a professional dog trainer and does not claim to be. Any discussion of training-related topics is offered for informational and reflective purposes only. For behavior or training concerns, consult a qualified dog trainer, behavior consultant, veterinarian, or veterinary behaviorist.

By agreeing to these terms, you confirm that you are not seeking counseling, therapy, or dog training services through the Program and do not expect Coach to provide any services other than those described here. If you believe you may be in need of therapy or counseling, the Program is not appropriate for you.

2. WHAT THE PROGRAM INCLUDES

The Program is a self-paced online mini course hosted on Kajabi. It consists of:

Recorded video lessons
Downloadable worksheets and written materials
Selected individual components of Coach's COPE framework

The Program is informational and educational. It does not include coaching sessions, community or group access, personalized feedback, or any direct or one-on-one contact with Coach.

3. COST AND ACCESS

The Program is provided at no cost. No payment is collected at enrollment or at any time thereafter. There is no paid tier, no automatic renewal, and no upsell attached to enrollment. Because no payment is collected, no refund provisions apply.

You are granted access to the Program content for as long as Coach continues to make the Program available. Coach reserves the right to modify, archive, restrict, or remove the Program and its contents at any time and for any reason, without notice, and is under no obligation to maintain the Program or your access to it indefinitely.

You may not share your login credentials with any other person. If credentials are shared with someone who did not enroll independently, access may be revoked.

4. EMAIL COMMUNICATIONS

Enrolling in the Program adds you to the Handlers & Humans email list. You will receive follow-up emails relating to the Program, along with ongoing newsletters and updates from Handlers & Humans, for as long as you remain subscribed.

You may unsubscribe at any time using the link included in every email. Unsubscribing does not affect your access to the Program.

5. FEEDBACK, TESTIMONIALS, AND MARKETING

The Program includes an optional feedback form. By submitting feedback, you grant Coach an ongoing, non-exclusive right to use anonymized content from that feedback, including written or screenshotted comments, for the purpose of promoting and marketing Handlers & Humans across social media, advertising, Coach's website, newsletters, and to prospective clients.

Before any such use, Coach will remove or obscure your name, image, handle, and any other directly identifying information. No further permission is required for the use of anonymized content, and you will not receive compensation for such use.

Coach will never share your name, image, likeness, or other identifying information publicly without your express written consent.

You may opt out of the use of your anonymized feedback at any time by notifying Coach in writing. Coach will honor the request going forward but is not obligated to remove materials already published.

6. INTELLECTUAL PROPERTY

Coach retains all copyright and other intellectual property rights in the Program and its content, including but not limited to video lessons, worksheets, written materials, prompts, resources, and the COPE framework.

You are granted a limited, revocable, non-transferable license to view and use the Program materials for your own personal use. Nothing in these Terms transfers ownership of any intellectual property to you or grants any license beyond what is expressly provided.

You may not copy, edit, distribute, duplicate, sell, forward, post, or otherwise share the Program or its content with any other person, and may not repurpose the content or present it as your own in your own business or practice, without Coach's express written permission.

If such conduct is discovered or reasonably suspected, Coach reserves the right to immediately revoke your access to the Program and to pursue any actionable infringement or misuse to the full extent of the law.

7. CONFIDENTIALITY

Coach respects your privacy and will not reveal information you share with Coach by email or through the Program feedback form without your consent, except in the following circumstances:

Suspected abuse of, or danger to, a child, an elder, another individual, or yourself (Jessica Adam is a mandated reporter of suspected abuse)
Where you have given written or verbal permission
Where disclosure is required by law, subpoena, or court order
Unintentional breach arising from electronic or online communication, including but not limited to email and direct messaging

You accept the risks inherent in electronic communication, including the possibility that a transmission could be distorted, interrupted, or accessed by unauthorized persons.

8. NO MEDICAL ADVICE AND NO GUARANTEES

The Program is provided for informational and educational purposes only. It is not medical advice, is not a substitute for mental health treatment, and is not intended to diagnose, cure, treat, or prevent any medical or mental health condition. Coach provides the Program in the capacity of a coach, separate and apart from Coach's professional counseling practice and licensure.

Coach encourages you to consult a physician or licensed therapist if you believe you may benefit from those services, and to discuss any changes to your health with an appropriate medical professional before making them.

Coach makes reasonable efforts to keep Program content accurate and current but makes no representation that all information is accurate or free of errors at all times, and assumes no responsibility for its accuracy, safety, or efficacy as applied to you.

Results are not guaranteed. Coach makes no representations or guarantees regarding individual outcomes and makes no guarantee of any particular financial outcome. Any testimonials or examples describing the results of others are individual, and results will vary.

The Program is provided on an "as is" basis, without guarantees, representations, or warranties of any kind, including warranties relating to quality, non-infringement, fitness for a particular purpose, or merchantability, to the fullest extent permitted by law.

9. VOLUNTARY PARTICIPATION AND ASSUMPTION OF RISK

You are voluntarily choosing to enroll in the Program and are solely responsible for your own outcomes and results. You acknowledge that Jessica Adam and Handlers & Humans LLC are not responsible or liable should you sustain injury, incur harm, or encounter negative consequences in connection with the Program. You are fully responsible for your own health and wellbeing.

If the Program suggests any physical activity or change to your routine, you are responsible for obtaining medical clearance from your own physician before attempting it. If you elect not to obtain such clearance, you accept the potential consequences and agree not to hold Coach responsible.

10. INDEMNIFICATION AND LIMITATION OF LIABILITY

You agree at all times to defend, fully indemnify, and hold harmless Coach and any affiliates, agents, team members, or other parties associated with Coach from any causes of action, damages, losses, costs, or expenses, including attorney's fees, arising from your use of the Program or from your breach of any obligation set out in these Terms of Use.

To the fullest extent permitted by law, Coach expressly disclaims liability for any direct, indirect, or consequential damages suffered by you in connection with your use of or participation in the Program, its materials, or Coach's website. IN NO EVENT SHALL COACH BE LIABLE TO YOU FOR ANY INDIRECT, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES.

11. DISCONTINUATION OF PROGRAM

If Coach becomes aware that you may be in need of medical care, therapy, counseling, or other treatment falling outside the scope of the Program, Coach will advise you to seek out a licensed professional in your own geographic area. Coach may, but is not obligated to, provide the name of a specific provider. You have the right to decline to act on this recommendation. You may, however, be asked to discontinue use of the Program for your own wellbeing until such treatment can be obtained.

Coach reserves the right to revoke access to the Program at any time where Coach determines that discontinuation is appropriate. Because the Program is provided at no cost, no refund arises from discontinuation.

12. DISPUTE RESOLUTION

If any issue arises in connection with the Program, please contact Coach first at [email protected] so that it can be resolved directly.

If the matter cannot be resolved informally, you agree that any dispute will be submitted to binding arbitration administered by the American Arbitration Association, before a mutually agreed arbitrator and in accordance with its rules, to be conducted within 50 miles of Fleetwood, Berks County, Pennsylvania. By agreeing to this term you understand that you are waiving your right to a jury trial that would otherwise be available to you.

The arbitrator's decision is final and binding, is not subject to appeal, and is enforceable in any court of proper jurisdiction in the Commonwealth of Pennsylvania. Because the Program is provided at no cost, no monetary award is available to you, and you are not permitted to seek consequential or punitive damages.

13. GENERAL PROVISIONS

13.1 Governing Law

These Terms of Use are governed by and construed under the laws of the Commonwealth of Pennsylvania, regardless of conflict of law principles and regardless of your location. Any action arising from these Terms shall be brought within Berks County, Pennsylvania.

13.2 Severability

The provisions of these Terms of Use are severable. The invalidity or unenforceability of any provision does not affect the validity or enforceability of any other provision. If any section, subsection, sentence, or clause is adjudged illegal, invalid, or unenforceable, that determination has no effect on these Terms as a whole or on any other portion of them.

13.3 Changes to These Terms

Coach may update these Terms of Use from time to time. Continued use of the Program after an update constitutes acceptance of the revised Terms.

13.4 Entire Agreement

These Terms of Use constitute the entire agreement between you and Coach with respect to the Program and supersede all prior agreements, discussions, and correspondence. If a feature or expectation is not described in these Terms, it does not apply and is not included in the Program.

14. ACKNOWLEDGEMENT

By enrolling in and using the Program, you voluntarily confirm that:

You understand the Program is informational and educational, and is not therapy, counseling, mental health treatment, or dog training
You are not seeking therapy, counseling, or mental health treatment through the Program
You are not seeking dog training services through the Program
You are enrolling voluntarily and of your own free will
You have read and understand these Terms of Use
You agree to abide by these Terms of Use
